Agreement to Terms

By entering this car park, you agree to these Terms and Conditions, which form a contract between ParkHub (“we”, “us”, “our”) and you, the user of the car park.

If you do not agree, please exit the car park immediately. No charges will apply if you leave promptly.

Compliance with Rules

You must follow all displayed signs, directions from our staff, and the general rules of the car park.

Only vehicles authorised by us may park in “Reserved” or specially marked areas.

Payment and Parking Period

This car park operates using a payment system (such as a parking meter, app, or other approved device).

You Must:

• Pay for parking at the displayed rates.
• Enter all required details correctly (e.g., vehicle registration).
• Park only for the period you have paid for, or within the time limit displayed.

Staying beyond your paid or permitted time may result in a Non-Compliance or Breach Notice.

1. Breach Notice Fee: If you breach these Terms, you agree to pay a Breach Notice Fee of $66 for each day (or part thereof) that your vehicle remains in breach. This represents a genuine pre-estimate of loss arising from non-compliance. A notice may be issued by being attached to your vehicle.
2. Administration and Collection Fees :If payment is not made by the due date on the Breach Notice:
   • A follow-up notice will be issued, and
   • An Administration Fee of $40 will apply.

If payment remains outstanding after 10 days, you also agree to pay any collection costs, including debt recovery and legal fees on a full indemnity basis.

3. Consumer Rights: Your rights under the Australian Consumer Law (ACL) are not excluded or limited by these Terms. For services not ordinarily acquired for personal, domestic, or household use, our liability is limited (where permitted by law) to re-supplying the service or paying the cost of having it re-supplied.
4. Liability and Risk : Subject to your ACL rights:
   • We are not liable for any loss, damage, injury, or economic loss arising from your use of this car park, including theft, vandalism, weather, or malfunctioning equipment.
   • All vehicles and belongings are left entirely at your own risk.
5. Keys and Vehicle Access: If you leave your keys with us, you authorise us to release your vehicle to any person presenting the ticket or other proof of entitlement we accept as valid.
6. Custody and Responsibility: Our staff, agents, or contractors are not authorised to accept items for safe keeping. We are not liable for any property or vehicle alleged to have been left in our care.
7. Security Interest: You grant us a security interest over your vehicle (as defined under the Personal Property Securities Act 2009 (Cth)) for any unpaid amounts under these Terms. We may retain possession of the vehicle until full payment is received.
8. If payment remains outstanding for more than 30 days, we may sell the vehicle and apply the proceeds to recover the debt and related costs.
9. Vehicle Movement: We reserve the right to enter or move your vehicle if:
   • It is causing an obstruction,
   • It appears abandoned,
   • It must be moved for safety, operational, or emergency reasons.
   • A reasonable fee may apply if movement is due to your breach.
10. Damage and Cleaning: You are responsible for any damage caused by you or your vehicle to the car park, including leaks or spills. You must reimburse us for any cleaning or repair costs.
11. Indemnity: You agree to indemnify Park Hub for any loss, cost, or expense arising from:
    • Your breach of these Terms;
    • Damage caused by your vehicle; or
    • Your use of the car park. Your liability is reduced to the extent that our own negligence caused or contributed to the loss.
